Energy Policy Act of 2005,
(PL 109-58 Sec. 388). Section 388 allows the use of retired offshore oil
and gas platforms for any “marine related purpose.” This authorization
is responsible for the Bureau of Ocean Energy Management Regulation
Enforcement (BOEMRE) Ocean Energy and Alternate Uses of Offshore
Facilities, Alternate Energy and Alternate Use (AEAU) program (30 CFR
285.1000). Section 388 surfaced in PL 109-58 shortly after the
publication of the Kolian and Sammarco (2005) Technical Report:
Mariculture and other uses for offshore oil and gas platforms: Rational
for Retaining Infrastructure.”
